To avoid any unnecessary risk to your firm and your client, conveyancers should undertake bankruptcy searches against the property buyer, seller or gifter of funds in all cases. You must undertake bankruptcy searches against a purchaser where there is a lender and bankruptcy searches against any party to a deed of gift . This includes a buyer, seller or gifter who lives abroad (or has recently lived abroad)!

If the property seller, purchaser or gifter lives (or has previously lived) in a foreign country, bankruptcy searches should be conducted in that country to ensure that there are no foreign bankruptcy orders which would affect the purchase.
