What is the Spanish Bankruptcy Process for individuals?

Individuals may be declared bankrupt under Spanish law. The individual can declare themselves bankrupt -voluntary bankruptcy (concurso voluntario) or be declared bankrupt by a creditor- mandatory bankruptcy (concurso necesario).

Both Spanish and Foreign individuals resident in Spain can file for Spanish bankruptcy.

Petitions for bankruptcy in Spain must be filed with the particular Spanish Mercantile Court (Juzgado de lo Mercantil) which has jurisdiction for the debtor’s registered address. 

Similar to other EU countries, Spains have implemented a repayment model of bankruptcy, in which repayments continue for 5 to 7 years before discharging an individual from bankruptcy.

How can I check if someone is bankrupt in Spain.

Spain has a register of bankrupt individuals maintained by the Association of Regsitrars (Colegio de Registradores) pursuant to Royal Decree 892/2013 of 15 November 2013.

You can order a search of the relevant Spanish bankruptcy register via our website and we will provide you with a report to confirm whether the individual is subject to bankruptcy proceedings in Spain.
